PRIVACY NOTICE
ConstructionTech informs you that the information collected regarding legal entities and/or individuals held by ConstructionTech will be handled under the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and responsibility, based on the following terms and conditions:
- Identity and address of the responsible party:
This Privacy Notice (hereinafter referred to as “Notice”) sets forth the terms and conditions under which ConstructionTech, with its address at Calle Varsovia 36, Colonia Juárez, Cuauhtémoc, 06600 Mexico City, CDMX, in its capacity as “Responsible” (or the appointed Manager) will process the personal data of the Data Subject.
- Consent of the data subject:
For the purposes of the Federal Law on Protection of Personal Data Held by Private Parties (the “LFPDP”) and other applicable legislation, the Data Subject states: (i) that this Notice has been made known to them by the Responsible, (ii) having read, understood, and agreed to the terms set forth in this Notice, thereby giving their consent regarding the processing of their personal data. The Responsible will collect by electronic, optical, or any other technology, or by unequivocal signs, the following: (i) first name, (ii) last name, (iii) email, (iv) phone, (v) LinkedIn URL, (vi) password.\nIf the personal data collected includes financial or asset data, by signing the corresponding contract, either in printed format or using electronic means and their corresponding consent formation processes, acts will be carried out that constitute the express consent of the data subject and grant their consent for ConstructionTech or its Managers to make transfers and/or remissions of personal data under the terms of section 3 of this Notice.
- Purpose of data processing:
ConstructionTech will collect the personal data of the Data Subject in order to carry out activities focused on fulfilling its corporate purpose, derived from the obligations of any legal and/or commercial relationship, for informational or administrative purposes, established between the parties, which include but are not limited to the following:
- Create and manage the user account within the social network.
- Allow interaction between users, including posting content, comments, reactions, and messages.
- Facilitate communication between users and improve the experience within the platform.
- Ensure account security and prevent improper or fraudulent use.
- Provide technical support and user assistance
- Means offered by the responsible party to limit the use or disclosure of data:
The personal data collected by ConstructionTech will not be assigned, sold, shared, or transferred to a third party without prior notice and written consent, except in cases required by: (i) Public Institutions, government, administrative and/or judicial authorities in Mexico City, Federal, State, or Municipal; (ii) Financial Institutions in Mexico and abroad where the commercial relationship exists; and (iii) affiliates, employees, advisors, and service providers of ConstructionTech, who request it in order to carry out their daily activities and in cases provided by law.
- Procedure to exercise the rights of access, rectification, cancellation, or opposition and revocation of consent:
The Data Subject has the right to access, rectify, and cancel their data, as well as to oppose the processing of these or revoke the consent provided by submitting a request by email to [email protected]; which must contain the following information and documentation:
- The name of the data subject and address or email where the response to their request will be communicated;
- Scanned copy of the Data Subject’s valid official identification, and if applicable, power of attorney and valid official identification of the representative;
- A clear and precise description of the personal data for which any of the aforementioned rights are to be exercised, and
- Any other element or scanned document that facilitates the location of the personal data.
- In the case of requests for rectification of personal data, the Data Subject must also indicate the modifications to be made and provide the supporting documentation.
- Lawfulness and transfer:
If ConstructionTech needs to transfer the Data Subject’s personal data to third parties in order to fulfill its legal and/or commercial obligations, the recipients of the personal data are contractually obligated to maintain the confidentiality of the transferred personal data and to observe this Notice.\nConstructionTech and/or its Employees may communicate the collected personal data to any other company within the same business group to which the Responsible belongs and that operates with the same internal processes and policies, whether located nationally or abroad, for processing with the same purposes described in this Notice.\nYour personal information may be sent, stored, and processed in a country other than where it was provided, in accordance with applicable data protection laws.\nWe have database servers that allow us to manage data securely, always ensuring physical security through access controls and constant maintenance.\nConstructionTech does not require the Data Subject’s consent to make national or international transfers of personal data in the cases provided for in Article 37 of the LFPDP or in any other exception provided by the same or other applicable legislation.\nOnce the Data Subject has read this Privacy Notice, they will have five business days to express their refusal for the processing of personal data regarding any of the above items; their ARCO rights are also safeguarded.\nAny breach of the data or the physical or electronic repositories where they are stored by ConstructionTech will be notified on its website https://www.constructiontech.com, through mass media and/or directly to the Data Subject.
- Changes to the privacy notice:
ConstructionTech reserves the right to update or modify this Privacy Notice, due to changes required by law or with the intention of improving security, communication, information collection practices, etc. It is the responsibility of the Data Subject to periodically review the content of the Notice on the website https://www.constructiontech.com. The Data Subject may express their refusal regarding the changes made; if there is no express refusal, the Responsible will understand that the Data Subject has understood and agrees with the terms, which will constitute their consent.
